Client Agreement for Group Events and Horseback Riding:

Thank you for choosing Smoke Tree Stables, Inc. (“STS”) for your group event and horseback ride. This Agreement is entered into by and between Smoke Tree Stables, Inc., a California corporation (“STS”), and the undersigned group event representative (“Client”). To confirm your reservation and participation, please review this Agreement thoroughly, complete the required details, and return a signed copy to info@smoketreestables.com or Stacey@smoketreestables.com.

Acknowledgment of Responsibility: _______ By initialing here, the Client and/or their authorized representative acknowledges and accepts responsibility for ensuring that all terms, conditions, rules, and requirements outlined in this Agreement are fully communicated to the Client, as well as all guests, all onsite staffing and day- of event personnel.

Terms and Conditions

1: Weight and safety restrictions: For the safety of horses and riders, STS enforces strict height, weight, and BMI guidelines. Any participant who does not fall within the specified height and weight limitations will not be permitted to participate. It is the Client’s responsibility to communicate these restrictions to all participants in advance to prevent any misunderstandings or issues on the day of the event.

• Maximum weight: 240 lbs, with specific restrictions by height:

  • 5’10” or under: Must be less than 230 lbs

  • 5’9” or under: Must be less than 220 lbs

  • 5’8” or under: Must be less than 210 lbs

  • 5’7” or under: Must be less than 200 lbs

  • 5’6” or under: Must be less than 190 lbs

• 5’5” or under: Must be less than 180 lbs • 5’4” or under: Must be less than 170 lbs • 5’3” or under: Must be less than 160 lbs • 5’2” or under: Must be less than 150 lbs • 5’0” or under: Must be less than 130 lbs

Minimum age for riders: 7 years. Please notify us in advance if children are included in this reservation.

2. Reservation and Payment Requirements: Reservations are confirmed only upon receipt of a 50% deposit. No ride will be held or guaranteed without this deposit. Early Guarantee reservations require full payment at the time of booking and are non-refundable. Failure to secure an Early Guarantee reservation with payment in full will result in the ride not being considered confirmed or reserved, and the Client may forfeit the initial deposit. Early Guarantee bookings will not be held without full payment.

• Final payment for non-Early Guarantee reservations is due 30 days before the ride date.

• Early Guarantee Rides: If marked, require full payment upfront; these rides are non-refundable.

3. Cancellations: All cancellation requests must be submitted in writing to info@smoketreestables.com. The following policies apply:

• Cancellations for non early guarantee rides 31+ days prior: Subject to 10% non-refundable processing fee. • Cancellations within 30 days or less: Non-refundable and forfeit deposit.
• Early Guarantee Rides: 100% non-refundable.

4.Corporate Information requests: Should the Client require any additional documentation from Smoke Tree Stables, Inc., including but not limited to Certificates of Insurance, Workers’ Compensation certificates, it is the Client’s responsibility to request this in writing above and such requirements must be submitted prior to finalizing the booking. Failure to do so may result in the inability to accommodate these requests or your group.

5.Waivers: All riders and participants are required to complete and submit a digital waiver and release form no later than 72 hours prior to the scheduled ride date and time. These waivers are mandatory, they also gather critical information including rider names, height, weight, and experience level―enabling STS to create accurate manifests and ensure safety. Failure to submit waivers within the required timeframe will result in cancellation of the reservation with no refund, and all associated fees will apply. Riders who complete waivers past the 72-hour deadline will not be permitted to ride.

For all Destination Management Companies (DMCs), it is your sole responsibility to communicate this requirement to clients and the advance team staff at the time of reservation.

6.Guest Counts and Changes: At the time of booking, the Client must provide a total guest count for all riders. For Early Guarantee rides, this initial count is final, and full payment is required at booking. For non-Early Guarantee rides, final head-counts must be provided at time of booking and confirmed 30 days prior to the ride date.

No-Shows: Any day-of no-shows remain the responsibility of the group, and charges will apply for all reserved riders- non refundable.

Reservation Changes: Any changes to reservations must be approved in writing by STS. Once guest counts are finalized, the group is responsible for full payment of all reserved riders.

7. Special Accommodations: Your safety is our top priority, and we’re here to help whenever possible. If any participant requires special assistance, please let us know in advance so we can do our best to make appropriate arrangements when possible. However, if a participant’s needs are not disclosed beforehand or if Smoke Tree Stables determines it is unsafe for them to ride, we reserve the right to deny participation without a refund. While we strive to accommodate all guests, some guests may be prohibited from riding if we determine we cannot safely meet their needs.

8. Photography: Smoke Tree Stables must be notified in advance if a photographer will be on-site for any event. Commercial photography in the Indian Canyons is strictly prohibited without prior permits and approval from the Agua Caliente Band of Cahuilla Indians corporate offices.

Commercial Photography on site at STS location requires advanced notice and additional fee’s may apply.

9. No Pets Policy: Pets are strictly prohibited on the property, on the trail or in vehicles. This includes all service animals or emotional support animals, as riding activities occur on tribal land where animals are not permitted by law. If a group arrives with any pet, including a service animal, the group will be turned away without a refund no exceptions.

10. Late Arrivals: Timeliness is essential. Groups are requested to arrive 30 minutes prior to ride time. Please be aware that your group is not the only one we accommodate in a day. Any group arriving late may experience delays or forfeit their ride entirely, along with all associated fees and costs. If you would like to block off additional time to ensure flexibility, when possible this can be arranged at an additional cost. It is imperative that all guests arrive on time and prepared for their reservation.

11. Right to Refuse Service and Terminate Agreement: Smoke Tree Stables, Inc. (STS) is committed to upholding a positive, safe, and respectful environment for all guests, staff and horses. Should STS determine, at its sole discretion, that a client group or individual is not an appropriate fit for our facility, or if there are concerns regarding the safety of riders, horses or staff, STS reserves the right to cancel any booking without liability. Circumstances warranting cancellation include, but are not limited to:

• Failure of the booking party to communicate full contract requirements to clients, guests or onsite staff or personnel, including but not limited to arrival times, the 72-hour waiver submission deadline, height/weight restrictions, or any additional requirements that were not disclosed in advance;

• Guests arriving under the influence of alcohol, drugs, or other impairing substances that would make it unsafe to ride.

• Failure of a group or guest to follow instructions. Including rough behavior with horses

In the event STS exercises this right, possible guest removal, Client’s ride or entire event will be cancelled, and any refunds will be issued solely at the discretion of STS in accordance with our policies.

12. Headgear Requirement: All riders must wear provided protective headgear. Participants in ground-based activities only may opt out of wearing helmets.

13. Dress Code: For safety and comfort, we recommend that all riders wear long pants and closed-toed shoes. Please avoid hiking boots, steel-toed shoes, or any footwear with thick or grippy soles, as they may interfere with riding equipment. Backpacks and fanny packs are not permitted. Each rider will be provided with a saddle bag for personal items. Saddle bag is large enough to fit 4 -16oz water bottles.

14. Confidentiality: The Parties agree to keep confidential any and all information obtained during the course of this agreement, including, but not limited to, business practices, client information, and proprietary knowledge. Neither Party shall disclose such information to any third party without prior written consent from the other Party, except as required by law. This confidentiality obligation shall survive the termination of this agreement.

15. Force Majeure – Rights of Termination for Cause: STS prioritizes safety and maintains a commitment to clear and specific responsibilities. In the event of circumstances affecting STS, such as unsafe weather or natural disasters that make it unsafe or impossible for us to fulfill our obligations, STS will make every reasonable effort to reschedule the booked ride.

Notwithstanding, STS reserves the sole discretion to cancel any event due to unsafe weather conditions or natural disasters. If STS cancels an event due to weather and a reschedule is not possible, a refund will be issued to the client.

For clients, their performance under this Agreement may only be terminated upon the occurrence of the following events:

• Mandatory government-imposed shutdowns due to pandemic, or

• Acts of terrorism, both of which must directly affect Riverside County, California. STS shall not be held liable for cancellations or modifications due to any other events.

16. Limitation of Liability: STS shall not be held liable for any damages, loss, or injury arising out of or in connection with participation in the event, except in cases of gross negligence or willful misconduct. The Client agrees to indemnify and hold harmless STS, its employees, agents, and representatives from any claims arising from Client’s or participants’ actions that are in violation of this Agreement or applicable laws.

17. Acknowledgment of Contract Responsibility: By signing this Agreement, the Client and their designated representatives (including Destination Management Company representatives) acknowledge that they are responsible for ensuring that all onsite and day-of staff are informed of and adhere to the terms, rules, and requirements outlined herein.

18. Governing Law and Severability: This contract shall be governed by and construed in accordance with the laws of the State of California. In the event that any provision of this contract is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and such invalid provision shall be replaced with a valid provision that most closely approximates the intent and economic effect of the invalid provision.
